Special Order Agreement

This policy outlines the terms and conditions that apply to all special orders placed with Banks Lyon Jewellers Ltd. Special orders refer to any items that are not part of our regular stock and are procured specifically at the request of the customer.

1. Applicability

This policy applies to all special-order items requested by customers, whether in-store, online, or via any other official communication channel with Banks Lyon Jewellers Ltd.

2. Description of Goods

Special orders are non-stock items ordered specifically to meet a customer’s individual request. These may include specific models, references, or customisations from particular brands. As such, they are procured on a bespoke basis and are not held in our standard inventory.

3. Payment Terms

A deposit is required at the time the special order is placed. The balance must be settled in full by the date agreed at the point of order. Full payment must be received before the item is released or dispatched to the customer.

If the final balance is not paid within 90 days of the agreed due date, Banks Lyon Jewellers Ltd. reserves the right to cancel the order and retain the deposit as liquidated damages.

4. Cancellation and Refunds

Special-order items are non-returnable, non-exchangeable, and non-refundable, unless the goods are faulty or not as described, in accordance with the Consumer Rights Act 2015 and the Digital Markets, Competition and Consumers Act 2024.

Should a customer cancel a special order after it has been placed, Banks Lyon Jewellers Ltd. reserves the right to retain 25% of the total order value or the full deposit amount, whichever is greater, to cover restocking, shipping, and administrative costs.

5. Delivery and Collection

Estimated availability timescales will be provided at the time of order. Customers will be notified once the item has arrived. Items must be collected or arranged for delivery within 30 days of this notification. After this period, storage charges may apply.

6. Ownership of Goods

Ownership of any special-order item remains with Banks Lyon Jewellers Ltd. until full payment has been received. Until that point, the company retains both legal and beneficial ownership.

7. Acknowledgement and Acceptance

By placing a special order, the customer confirms that they understand and accept the terms of this policy, including the non-refundable and non-returnable nature of special-order items.

8. Governing Law

All special orders are subject to the laws of England and Wales, and any disputes will fall under the exclusive jurisdiction of the courts of England and Wales.
